You do not need to live in the US to have a filing obligation. Having income connected to the country is enough.

Who files a Form 1040-NR.
The 1040-NR applies whenever a non-resident has income connected to the United States. The most common cases:
- Foreign owners of an LLC: if your single-member LLC earns income connected to the US, the profit is reported on your personal 1040-NR. Progressive rates run from 10% to 37%.
- Foreign partners in a multi-member LLC: the partnership reports each partner's share, and you settle your portion with the 1040-NR.
- Non-residents with US-source wages or professional fees: income for work connected to the United States is reported here.
- Owners of US real estate with rental income: rent from US property is US-source income, and belongs on the 1040-NR.
- Anyone recovering excess withholding: if more was withheld than you owed, the 1040-NR is how you claim the refund.
The 1040-NR and Form 5472.
If you are the sole foreign owner of an LLC, your company files Form 5472 (with a pro-forma 1120) every year to report transactions with you, and you file the 1040-NR when there is income connected to the US. They are separate obligations, with separate penalties: failing to file the 5472 starts at $25,000; a missed 1040-NR generates penalties and interest on the tax owed, and forfeits your right to refunds or treaty benefits.
You do not need to live in the United States to have a US return. Having income connected to the country is enough.
