FinCEN defines money transmission services as accepting currency, funds, or other value that substitutes for currency from one person and transmitting it. If that is your business, you must register as a money services business. If you merely accept crypto as payment for your own products, generally you are not.

Banks decline crypto companies far more often than they decline other businesses, and the reason is almost never the technology. It is that the bank cannot tell, from your application, which of those two companies you are. The ones that get accounts are the ones that answer it before being asked.

What Makes a Company a Money Transmitter?

FinCEN is explicit that it turns on the facts: whether a person is a money transmitter depends on the facts and circumstances of a given case. There is no list of business types that are automatically in or out, which is why generic advice on this topic is worthless and why banks ask so many questions.

The exclusion that matters most to operating businesses is that a person is not a money transmitter if that person only accepts and transmits funds integral to the sale of goods or the provision of services, other than money transmission services, by the person who is accepting and transmitting the funds. In plain terms: taking payment for your own product is not transmitting money for other people.

Do I Have to Register With FinCEN?

If you are a money services business, yes, and the mechanics are specific. Registration is on FinCEN Form 107, it must be completed within 180 days after the date on which the business is established, and it must be renewed every two years. Missing that window is not a paperwork problem, it is the thing a compliance officer finds later.

Why Do Banks Reject Crypto Companies Specifically?

Because an unregistered money transmitter on their books is the bank's problem, not only yours. A bank that onboards you inherits the obligation to monitor what flows through the account, and it prices that risk by asking whether your model creates it. Ambiguity reads as risk, so a vague answer is treated as the expensive answer.

This is why the same company gets rejected by one institution and approved by another with a better-prepared file. The variable is rarely the business. It is whether the flow of funds was explained in the bank's own vocabulary.

What Should Be Ready Before Applying?

A written description of exactly whose money moves and why. Who sends value, who receives it, whether it ever rests with you, and whether any of it belongs to a third party at any moment. If value only ever moves from a customer to you in exchange for something you sold, say so in those words.

Then the ordinary file: the entity documents, the EIN, the ownership disclosure, and a real operating address. A crypto company with an incomplete standard file is judged on the crypto. A crypto company with a complete one is judged on the flow of funds, which is a conversation you can win.
